Functions

The Ministry of Equality is responsible for proposing and implementing the Government ' s policy on equality and policies aimed at making real and effective equality between women and men, the prevention and eradication of various forms of violence against women and the elimination of all forms of discrimination based on sex, racial or ethnic origin, religion or ideology, sexual orientation, gender identity, age, disability or any other personal or social condition or circumstance.

It is responsible, in particular, for the elaboration and development of rules, actions and measures aimed at ensuring equal treatment and opportunities, especially between women and men, the promotion of the social and political participation of women, and the prevention and eradication of any form of violence against women.

  1. The promotion and development of the transversal application of the principles of equal treatment and opportunities between women and men in the performance of public authorities and, especially, in the General Administration of the State.
  2. Monitoring the application and normative development of Organic Law 3/2007, of March 22, for the effective equality of women and men.
  3. Monitoring the application and normative development of Organic Law 1/2004, of December 28, on Comprehensive Protection Measures against Gender Violence.
  4. The promotion and monitoring of compliance with the measures provided for in the State Pact against Gender Violence, as well as the implementation of the necessary measures for the prevention and eradication of all forms of violence against women, in collaboration with State institutions and Public Administrations with competence in this field, as well as with civil society organizations.
  5. The proposal of rules and measures to combat trafficking in women for the purpose of sexual exploitation, as well as their coordination, monitoring and evaluation.
  6. The coordination of the policies of the General Administration of the State in matters of equal treatment and opportunities, with special reference to equality between women and men, as well as the development of cooperation policies with the administrations of the autonomous communities and local entities in matters within their competence, without prejudice to the competences attributed to other departments.
  7. The promotion of measures to promote equal treatment and opportunities, with special reference to equality between women and men, and the expansion of guarantees and citizens' rights, through the development of policies that address specific problems of inequality adapted to the specific needs of different groups of people, without prejudice to the competences attributed to other departments.
  8. The proposal of the necessary measures to consolidate the presence of women in any areas of life, guaranteeing the balanced presence of women and men, progressively, in the terms set out in Organic Law 3/2007, of 22 March, in public bodies and bodies and in the boards of directors of public and private societies.
  9. The participation, together with the corresponding bodies of the Ministry of Labour and Social Economy, in the promotion of policies aimed at ensuring equal treatment and opportunities between women and men in employment and occupation, and at reducing labour discrimination and female unemployment, aiming at full employment and reducing the existing differences between the wage perceptions of men and women through, among other measures, the support and facilitation of the implementation of equality plans in companies.
  10. The promotion of measures that favor the reconciliation of work with personal and family life, as well as co-responsibility in family responsibilities, promoting, among others, the equalization of paternity and maternity leave and the development of programs to promote responsible parenthood.
  11. The implementation of training, information and awareness-raising activities aimed at giving effect to the principle of equal treatment and opportunities between women and men in all areas of life.
  12. The promotion and development of the transversal application of the principle of equal treatment and non-discrimination of persons on the basis of sex, racial or ethnic origin, sexual orientation, gender identity, religion or beliefs, ideology, age, disability or any other personal or social condition or circumstance.
  13. The proposal for normative measures aimed at ensuring equal treatment and non-discrimination of persons, regardless of their sex, racial or ethnic origin, sexual orientation, gender identity, religion or belief, ideology, age, disability or any other personal or social condition or circumstance.
  14. The implementation of training, information and awareness-raising activities aimed at giving effect to the principle of equal treatment and non-discrimination of persons on grounds of sex, racial or ethnic origin, national origin, sexual orientation, gender identity, religion or belief, ideology, age, disability or any other personal or social condition or circumstance, in any area of life.
  15. In coordination with other ministerial departments, propose and promote the implementation of measures aimed at making a diagnosis for the prevention and eradication of hate crimes and hate speech in the public and private spheres.
  16. In coordination with other Public Administrations, the promotion of measures aimed at recognizing and protecting the heterogeneity of the family fact.
  17. In collaboration with the corresponding bodies of the Ministry of Foreign Affairs, European Union and Cooperation, the supervision and follow-up of international agreements on equality and non-discrimination, the organization and participation of Spain in international summits and events on the subject, the preparation of reports for international institutions and the follow-up of international projects and meetings related to equality promoted by the Government of Spain, without prejudice to the competences of the Technical General Secretariat of the department in this matter.

  1. The direction, promotion and coordination of the actions related to the participation of the department in the collegiate bodies of the Government and in those of collaboration and support to the Government.
  2. Assist the head of the Ministry in monitoring the effectiveness of the department and its public agencies.
  3. The responsibility for providing legal advice to the person in charge of the Ministry in the performance of his/her duties and, in particular, in the exercise of his/her regulatory authority and in the production of administrative acts falling within the competence of the Ministry, as well as to the other bodies of the Ministry.
  4. The preparation of the annual preliminary draft budget of the Ministry and the coordination of the corresponding budgets of the entities and public agencies attached, as well as the monitoring of the budget execution and processing of its modifications.
  5. Economic and financial management, as well as planning and monitoring of administrative contracting.
  6. The planning, direction and administration of the human resources of the department and relations with trade union organizations and personnel representative entities, as well as the management of training plans, social action and occupational risk prevention programs.
  7. The processing of compatibility files relating to the personnel of the Ministry, as well as of its public bodies linked to which the regulations on incompatibilities of personnel in the service of the Public Administrations apply. Likewise, it is responsible for the exercise of the disciplinary authority of the personnel of the department, in the terms provided in the legislation that results from application.
  8. The implementation of service inspection plans and programs and the evaluation of the functioning of the organs and units of the services, entities and public agencies attached.
  9. The exercise of the functions of the Equality Unit of the Ministry, as foreseen in article 77 of Organic Law 3/2007, of March 22 and in accordance with Royal Decree 259/2019, of April 12, which regulates the Equality Units of the General Administration of the State.
  10. The coordination of the evaluations of the public policies of competence of the department and, where appropriate, the execution of the same, as determined by the head of the Ministry, in accordance with the plan of public policy evaluations approved by the Council of Ministers, with the support of the Institute for the Evaluation of Public Policies of the Ministry of Territorial Policy and Public Function.
  11. The management of tangible property, furniture and real estate and its inventory, leases, the execution of works and the maintenance and conservation of the buildings of the Ministry.
  12. The direction and coordination of the Registry Assistance Offices, as well as the technical, security, reprography and, in general, internal affairs and general affairs services of the Ministry.
  13. The planning, direction and coordination of information systems; the development, preparation and proposal of needs of technological resources, as well as the provision of information technology services and the direction and coordination of the web portal, electronic headquarters and intranet.
  14. The elaboration, development and execution of the digitization plans of the department, as well as the implementation and monitoring of the digital transformation plans of the General Administration of the State, in coordination with the General Secretariat of Digital Administration of the Ministry of Economic Affairs and Digital Transformation.
  15. The coordination and supervision of the data protection policy in compliance with the applicable regulations in this field in the area of the competences of the department and, in particular, exercise the competences related to the data protection delegate, provided for in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 for the scope of the Ministry, excluding its Public Bodies, and in Organic Law 3/2018, of 5 December, on the Protection of Personal Data and guarantee of digital rights.
