Functions

The Ministry of Consumer Affairs is the Department of the General Administration of the State responsible for proposing and implementing the Government ' s consumer and consumer protection and gambling policy.

  1. Strategic planning of public policies related to the competence of the Ministry of Consumer Affairs.
  2. The proposal for the inclusion of the normative projects of competence of the General Secretariat in the annual normative plan, at the request of the Directorates-General dependent on the General Secretariat, as well as the direction and coordination of the exercise of the competences of the aforementioned Directorates-General and the proposal and formalization of their objectives and action plans.
  3. The promotion of inter-territorial institutional cooperation and participation in the corresponding international and European Union bodies by reason of the matter.
  4. Coordination of the participation of the governing bodies belonging to the General Secretariat for Consumer Affairs and Gambling in the development and application of European regulations on consumer protection and gambling.
  5. Support for the work, agreements and deliberations of the Sectoral Consumer Conference through the Chair of the Sectoral Consumer Commission.
  6. The coordination of policies and strategies of action that guarantee information, education and promotion of consumption and a responsible and sustainable participation in gambling.
  7. The promotion and coordination of public policies on consumption and healthy food, offering guarantees of food security and quality information to consumers and economic agents in the Spanish agri-food sector.
  8. The guarantee and promotion of the rights of consumers, especially those who may be in a situation of vulnerability.
  9. The promotion and coordination of responsible and informed gambling policies, with attention to guaranteeing public health and the rights of people in vulnerable situations, in coordination and without prejudice to the competences of the Ministries of Health and Social Rights and Agenda 2030 in the matter.
  10. The implementation of institutional campaigns aimed at increasing the information and training of citizens in relation to the subjects subject to their competence.

  1. The direction, promotion, coordination and management of actions relating to the processing by the Department of matters submitted to the Council of Ministers, the Government Delegated Commissions and the General Commission of Secretaries/Secretaries of State and Under-secretaries/Under-secretaries.
  2. The elaboration and coordination of the Department ' s general plans in the areas of regulations, budgetary policy, personnel and remuneration, property, buildings and infrastructure, information and communication technologies, economic programming and budgetary control.
  3. Assistance to the head of the Ministry in monitoring the effectiveness and activity of the Ministry and its public agencies, as well as the direction of the inspection function on the services, agencies and centres dependent on the Department, especially with regard to personnel, procedures, economic regime, facilities and endowments of these.
  4. The responsibility for supporting, supervising and providing legal advice to the person in charge of the Ministry, as well as to the persons in charge of the other governing bodies of the Department, in particular, in the exercise of regulatory authority and in the production of administrative acts, as well as with regard to the procedures related to their publication.
  5. The management of administrative services, their rationalization and computerization, statistics, administrative information and documentation and the handling of matters not attributed to the competence of other governing bodies of the Department.
  6. The preparation of the proposal for the annual budget of the Ministry and the coordination of those corresponding to the entities and public agencies attached, as well as the monitoring of the budget execution and the processing of its modifications.
  7. The economic and financial management of the Ministry and its execution in areas other than those of the Department ' s governing bodies and dependent agencies; the study, preparation and proposal of contracts to be concluded by the Department, without prejudice to the competencies attributed to other bodies of the Ministry, as well as the coordination, assistance and support of the collegiate bodies of the Ministry in the field of recruitment.
  8. The property management of tangible property, furniture and real estate linked to the Department and its various agencies, as well as the maintenance of the inventory of such property, and the property management relating to leases, the execution of works and the maintenance and conservation of the buildings of the services attached to the Ministry and its attached agencies.
  9. The financial economic processing of grant awards and agreements, commissions and other legal acts and businesses when they involve the acquisition of financial commitments by the Department and are not attributed to other Units and bodies.
  10. The authorization of service commissions entitled to compensation for the Department ' s staff and service commissions entitled to compensation in the exact amount of persons holding senior positions under the Under-Secretariat.
  11. The empowering and paying functions of the Ministry, except in cases where the actions of a certain unit or organ of the Ministry require placing in them an own paying box, as well as those relating to the Central Unit of the Paying Box.
  12. The application and monitoring of austerity measures and rationalization of public spending through specific instructions on the use of means in the Department and the agencies attached to it.
  13. The planning, direction, management and administration of the human resources of the Department and its different agencies; the senior leadership of all staff; the proposal of public employment, selection and provision; the development of job relations, management of salaries and relations with trade unions and staff representative bodies.
  14. The establishment of staff training plans and management of social action and occupational risk prevention programs within the Department and its affiliated agencies.
  15. The exercise of disciplinary authority for serious or very serious misconduct of the staff of the Department, except for separation from service.
  16. The processing of compatibility files relating to the personnel of the Ministry, as well as of public agencies and entities linked to it to which the regulations on incompatibilities of personnel in the service of public administrations apply.
  17. The implementation of the plans and programs of inspection of the services of the organs and agencies dependent or attached to the Department; the evaluation of the functioning of the services and the proposals for the improvement of the quality, as well as any other function that within the nature of the competences of the inspections of services is attributed to them by the legal system in force as foreseen in Royal Decree 799/2005, of 1 July, by which the general inspections of services of the Ministerial Departments are regulated.
  18. The exercise of the functions of the Equality Unit of the Ministry, as foreseen in article 77 of Organic Law 3/2007, of 22 March, for the effective equality of women and men, and in accordance with Royal Decree 259/2019, of 12 April, which regulates the Equality Units of the General Administration of the State.
  19. The coordination of public policy evaluations within the competence of the Department and its various agencies, and, where appropriate, the conduct of such evaluations as may be determined by the Minister, in accordance with the plan of public policy evaluations approved by the Council of Ministers, with the support of the competent body for public policy evaluation of the Ministry of Territorial Policy and Public Service.
  20. The support and coordination of the initiatives of the Department and its different agencies in the field of Open Government; as well as the exercise of the functions of the Complaints and Suggestions Management Unit of the central services of the Department, as foreseen in article 14 of Royal Decree 951/2005, of 29 July, establishing the general framework for the improvement of quality in the General Administration of the State.
  21. The direction and coordination of administrative information services and relations with citizens, in the terms established in their regulatory regulations and the maintenance of the information contained in the Administrative Information System. Also, the direction and coordination of registration and reprography assistance offices.
  22. Coordination of the institutional advertising and communication campaigns of the Department’s management centers and its different agencies.
  23. The definition, direction, planning, coordination and supervision of the implementation of the strategy on information and communication technologies and other technological resources of the Ministry and its different agencies, in accordance with the Digital Transformation guidelines adopted by the General Administration of the State.
  24. The analysis and development of the information systems necessary for the operation of the services and for the analysis and exploitation of data available for the evaluation of public policies, the promotion of digital transformation and innovation in the Department and, where appropriate, in its different agencies.
  25. The management and administration of voice and data communication networks, the implementation of computer security measures and the management and administration of the Ministry's presence on the Internet, including the development of the Ministry's web portals, electronic headquarters and intranet, as well as the promotion of the Department's presence on social networks.
  26. The coordination and supervision of the data protection policy in compliance with the applicable regulations in this field within the scope of the competences of the Department and its different agencies. In particular, it will exercise the powers relating to the data protection delegate, provided for in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 for the scope of the Ministry, excluding its affiliated agencies, and in Organic Law 3/2018, of 5 December, on the Protection of Personal Data and guarantee of digital rights.
