Institutional Public Sector

According to the Law 40/2015, of 1 October, of the Public Sector Legal System, the institutional public sector is composed of:

  1. Any public bodies and entities of public law linked or dependent on the Public Administrations.
  2. Private law entities linked or dependent to the Public Administrations that will be subject to the provisions of the rules of this Law that specifically refer to them, in particular the principles provided in article 3, and in any case, when they exercise administrative powers.
  3. Public universities that will be governed by their specific regulations and alternately by the provisions of this Law.

Composition and classification of the state institutional public sector

The state institutional public sector is composed of the following entities:

  1. Public bodies linked to or dependent on the General Administration of the State, which are classified as:
    1. Autonomous bodies.
    2. Public corporate bodies.
    3. State agencies.
  2. The independent administrative authorities.
  3. The state-owned commercial companies.
  4. The consortiums.
  5. The foundations of the public sector.
  6. Funds without legal personality.
  7. Public universities not transferred.
