In the territorial organization of the General Administration of the State, the governing bodies are both the Delegates or Delegates of the Government in the Autonomous Communities, who will have the rank of Undersecretary or Undersecretary, and the Subdelegates or Subdelegates of the Government in the provinces, who will have the level of Deputy Director or Assistant Director General.
There will be a Government Delegation in each of the Autonomous Communities.
The Government Delegations shall have their headquarters in the locality where the Governing Council of the Autonomous Community is located, unless the Council of Ministers agrees to locate it in a different one and without prejudice to the express provisions of the Statute of Autonomy.
The Government Delegations are organically attached to the Ministry of Territorial Policy.
In each of the provinces of the multi-provincial Autonomous Communities, there will be a Subdelegate of the Government, who will be under the immediate dependence of the Delegate of the Government.
Subdelegations of the Government in the uniprovincial Autonomous Communities may be created by Royal Decree, when circumstances such as the population of the territory, the volume of management or its geographical, social or economic peculiarities justify it.
The holders of the Government Delegations represent the Government of the Nation in the territory of the respective Autonomous Community, without prejudice to the ordinary representation of the State in them through their respective Presidents.
They will direct and supervise the General Administration of the State in the territory of the respective Autonomous Communities and coordinate it, internally and where appropriate, with the own administration of each of them and with that of the Local Entities located in the Community.
They are management bodies with the rank of Under-Secretariat that depend organically on the President of the Government and functionally on the competent Ministry for the matter.
They will be appointed and separated by Royal Decree of the Council of Ministers, on the proposal of the President of the Government. Your appointment will meet criteria of professional competence and experience. In any case, it must meet the requirements of suitability established in Law 3/2015, of March 30, regulating the exercise of the high office of the General Administration of the State.
In case of absence, vacancy or illness of the holder of the Government Delegation, it will be replaced by the holder of the Government Subdelegation that the Delegate designates and, failing that, by that of the province in which it has its headquarters. In the uniprovincial Autonomous Communities in which there is no Subdelegation, the replacement shall be the head of the General Secretariat.
They have the following organs:
Government subdelegations in the provinces and Island Directorates.
General Secretariat and, where appropriate, Deputy Secretary-General.
Functional areas, for the management of the integrated services of Promotion, Industry and Energy, Health and Social Policy, High Inspection of Education and Work and Immigration.
Cabinet, as a body of support and immediate assistance to the Delegate.
Territorial Assistance Commission, composed of the Subdelegates of the Government, the Island Directors where applicable, the Secretary-General, the Chief of Staff, the Directors of the Functional Areas and those responsible for the non-integrated services that the Government Delegate determines.
There is a Subdelegation of the Government in each of the provinces of the multi-provincial Autonomous Communities.
In the Autonomous Communities uniprovincial, Government Subdelegations can be created when circumstances such as the population of the territory, the volume of management or its geographical, social or economic peculiarities justify it.
In the islands of Menorca, Ibiza-Formentera, Lanzarote, Fuerteventura, La Palma, El Hierro and La Gomera, there is a Director or Director insular of the General Administration of the State.
The Directors or the Island Directors will depend hierarchically on the Delegate or Delegate of the Government in the Autonomous Community or the Subdelegate or Subdelegate of the Government in the province when this position exists.
Insular Directorates of the General State Administration
The islands in which there will be an Insular Directorate of the General Administration of the State, with the level determined in the list of jobs, will be determined by regulation. They will be appointed by the holder of the Government Delegation through the procedure of free appointment among career officials of the State, of the Autonomous Communities or of the Local Entities, belonging to Bodies or Scales classified as Subgroup A1.
The Island Directorates are hierarchically dependent on the Government Delegation in the Autonomous Community or on the Government Subdelegation in the province, when this office exists, and exercise, within their territorial scope, the powers conferred by this Law on the Government Subdelegations in the provinces.
