The Ministry of Equality is responsible for proposing and implementing the Government ' s policy on equality and policies aimed at making real and effective equality between women and men, the prevention and eradication of any form of violence against women, and of any form of violence or discrimination against persons based on their sex, racial or ethnic origin, religion or belief, sexual orientation, sexual or gender identity, gender expression, sexual characteristics, age, disability or any other personal or social condition or circumstance.
It is responsible, in particular, for the elaboration and development of rules, actions and measures aimed at ensuring equal treatment and opportunities, especially between women and men, and the promotion of the full participation of women in political, cultural, economic and social life.
The competences attributed in this royal decree shall be understood in coordination and without prejudice to those that correspond to other ministerial departments.
The holder of the Ministry of Equality is responsible for the exercise of the functions provided for in articles 61 of Law 40/2015, of 1 October, on the Legal Regime of the Public Sector, and in article 4 of Law 50/1997, of 27 November, of the Government.
The promotion and development of the transversal application of the principles of equal treatment and opportunities between women and men, as well as the gender and intersectional perspective, in the actions of the public authorities and, especially, in the General Administration of the State.
Monitoring the implementation and normative development of Organic Law 3/2007, of 22 March, for the effective equality of women and men; Organic Law 1/2004, of 28 December, on comprehensive protection measures against gender violence; Organic Law 10/2022, of 6 September, on comprehensive guarantee of sexual freedom; Law 15/2022, of 12 July, comprehensive for equal treatment and non-discrimination; and Law 4/2023, of 28 February, for the real and effective equality of trans people and for the guarantee of the rights of LGBTI persons.
The promotion and monitoring of compliance with the measures provided for in the State Pact against Gender Violence, as well as the implementation of the necessary measures for the prevention and eradication of all forms of violence against women, in collaboration with State institutions and public administrations with competence in this field, as well as with civil society organizations.
The proposal of norms and measures to combat trafficking in women and girls for the purpose of sexual exploitation, as well as their coordination, monitoring and evaluation.
The coordination of the policies of the General Administration of the State in matters of equal treatment and opportunities, with special reference to equality between women and men, as well as the development of cooperation policies with the administrations of the autonomous communities and local entities in matters within their competence, without prejudice to the competences attributed to other departments.
The promotion of measures to promote equal treatment and opportunities between women and men and the necessary measures to consolidate the presence of women in any areas of life, and to guarantee the equal composition or balanced presence of women and men, progressively, in the terms set forth in Organic Law 3/2007, of 22 March, and other regulations that may be applied.
The promotion of measures to promote the real and effective equality of LGBTI+ persons and the prevention and eradication of any form of discrimination or LGBTI-phobic violence, without prejudice to the competences attributed to other departments.
Promotion of measures to promote equal treatment and non-discrimination and to prevent and eradicate racism, racial discrimination, xenophobia and related intolerance, without prejudice to the competencies attributed to other departments.
In collaboration with the corresponding bodies of the Ministry of Labour and Social Economy, the promotion of policies aimed at ensuring equal treatment and opportunities between women and men in employment and occupation, and at reducing employment discrimination and female unemployment, aiming at full employment and reducing the existing differences between the wage perceptions of men and women through, among other measures, the support and facilitation of the implementation of equality plans in companies and measures of transparency and equal pay.
The promotion of measures that favor the reconciliation of work with personal and family life, as well as co-responsibility in family care and responsibilities, without prejudice to the competences attributed to other departments, promoting, among other measures, the equalization of birth and care permits for minors and the development of programs to promote responsible parenthood.
The implementation of training, information and awareness-raising activities aimed at giving effect to the principle of equal treatment and opportunities between women and men in all areas of life.

The implementation of training, information and awareness-raising activities aimed at giving effect to the principle of equal treatment and non-discrimination of persons on grounds of sex, racial or ethnic origin, national origin, sexual orientation, sexual or gender identity, religion or belief, age, disability or any other personal or social condition or circumstance, in any area of life.
(ñ) Proposing and promoting diagnostic measures for the prevention and eradication of hate crimes and hate speech in the public and private spheres, in coordination with other ministerial departments.
The promotion of measures aimed at recognizing and protecting family heterogeneity, in coordination with other ministerial departments and public administrations.
In collaboration with the corresponding bodies of the Ministry of Foreign Affairs, European Union and Cooperation, the supervision and follow-up of international agreements on equality and non-discrimination, the organization and participation of Spain in international summits and events on the subject, the preparation of reports for international institutions and the follow-up of international projects and meetings related to equality promoted by the Government of Spain, without prejudice to the competences of the Technical General Secretariat of the department in this matter.
Relations with the Independent Authority for Equal Treatment and Non-Discrimination.
The direction, promotion and coordination of the actions related to the participation of the department in the collegiate bodies of the Government and in those of collaboration and support to the Government.
Assistance to the head of the Ministry in monitoring the effectiveness of the department and its public agencies.
The responsibility for providing legal advice to the person in charge of the Ministry in the performance of his/her duties and, in particular, in the exercise of his/her regulatory authority and in the production of administrative acts falling within the competence of the Ministry.
The preparation of the annual preliminary draft budget of the Ministry and the coordination of the corresponding budgets of the entities and public agencies attached, as well as the monitoring of the budget execution and processing of its modifications.
Economic and financial management, as well as planning and monitoring of administrative contracting.
The planning, direction and administration of the human resources of the department and relations with trade union organizations and personnel representative entities, as well as the management of training plans, social action and occupational risk prevention programs.
The processing of compatibility files relating to the personnel of the Ministry, as well as of its public bodies linked to which the regulations on incompatibilities of personnel in the service of public administrations apply. Likewise, it is responsible for the exercise of the disciplinary authority of the personnel of the department, in the terms provided in the legislation that results from application.
The implementation of service inspection plans and programs and the evaluation of the functioning of the organs and units of the services, entities and public agencies attached.
The exercise of the functions of the Equality Unit of the Ministry, as foreseen in article 77 of Organic Law 3/2007, of March 22, and in accordance with Royal Decree 259/2019, of April 12, which regulates the Equality Units of the General Administration of the State.
The exercise of the functions of Inclusion Unit for staff with disabilities, in accordance with the fifteenth additional provision of Royal Decree-Law 6/2023, of 19 December, which approves urgent measures for the implementation of the Plan of Recovery, Transformation and Resilience in the field of public service justice, public service, local regime and patronage.
The coordination of the evaluations of the public policies of competence of the department and, where appropriate, the execution of the same, as determined by the person in charge of the Ministry, in accordance with the plan of public policy evaluations approved by the Council of Ministers, with the support of the Institute for the Evaluation of Public Policies.
The management of tangible property, furniture and real estate and its inventory, leases, the execution of works and the maintenance and conservation of the buildings of the Ministry.
The direction and coordination of the Registry Assistance Offices, as well as the technical, security, reprography and, in general, internal affairs and general affairs services of the Ministry.
The planning, direction and coordination of information systems; the development, preparation and proposal of needs of technological resources, as well as the provision of information technology services and the direction and coordination of the web portal, electronic headquarters and intranet.
The elaboration, development and execution of the digitization plans of the department, as well as the implementation and monitoring of the digital transformation plans of the General Administration of the State, in coordination with the General Secretariat of Digital Administration of the Ministry for Digital Transformation and the Public Service.
