Information on the functions of the Ministry of the Presidency, Relations with the Courts and Democratic Memory and its public, linked or dependent bodies.

Functions

It is the responsibility of the Ministry of the Presidency, Relations with the Courts and Democratic Memory:

  • The coordination of matters of constitutional relevance.
  • The preparation, development and monitoring of the legislative programme.
  • Immediate support for the Presidency of the Government.
  • Assistance to the Council of Ministers, the Government Delegated Commissions, the General Commission of Secretaries/Secretaries of State and Under-Secretaries/Under-Secretaries and, in particular, the Government in its relations with the Cortes Generales.
  • The inter-ministerial coordination entrusted to it by the current provisions, the Government or its President; the coordination and analysis of the quality of the normative activity of the Government.
  • The functions of material support, economic-financial management, budget, personnel and, in general, as many others of this nature as the President of the Government and the bodies dependent on the Presidency of the Government require.
  • The exercise of the powers related to the use of the flag, the shield and other national symbols as well as the other powers attributed by the legal system.
  • It is also responsible for proposing and implementing the Government ' s policy on historical and democratic memory, as well as the exercise of the right to freedom of religion and worship.

  1. The attendance or representation of the head of the Ministry of the Presidency, Relations with the Courts and Democratic Memory in the meetings of the Boards of Spokespeople of the Chambers, when the Government deems it appropriate to attend them, all in accordance with the provisions of the Regulations of the Congress of Deputies and the Senate.
  2. The transmission to the General Courts of the writings and communications that the Government sends to the Chambers, except in the case of international treaties and conventions, draft laws, royal decree-laws and royal legislative decrees, the transmission of which corresponds to the head of the Ministry of the Presidency, Relations with the Courts and Democratic Memory, without prejudice to its electronic communication by the person who occupies the Secretariat of State to the Chambers.
  3. The study, monitoring and coordination of the parliamentary processing of the Government ' s legislative programme.
  4. The coordination of the administrative activity of the relations of the Government with the Cortes Generales and assistance to the Government in the field of parliamentary control and, in general, in its relations with the Chambers.
  5. The coordination of matters of constitutional relevance.
  6. The realization of studies and reports related to the initiatives of constitutional reform and reform of the Statutes of Autonomy.
  7. The monitoring, evaluation and, where appropriate, the formulation of proposals in relation to the program and legislative activity of the Government.
  8. Any other function that may derive from the activity of the Cortes Generales in their relations with the Government.

  1. The promotion, in collaboration with the corresponding public and private entities, of the Declaration of Places of Democratic Memory as spaces that reveal interest for their historical, symbolic significance or for their repercussions on collective memory, linked to the struggle for democratic rights and freedoms.
  2. The proposal and, where appropriate, agreement, within the competence of the Ministry of the Presidency, Relations with the Courts and Democratic Memory, on the withdrawal of any symbol of personal or collective exaltation of civil war or dictatorship and, in agreement with the competent administrations, the adoption of the necessary measures for its execution.
  3. The proposal of measures to be adopted by the ministerial departments in the different archives, documentary centres, portals or similar figures of a public or private nature dedicated to Democratic Memory, as well as the promotion of measures to promote the right of access to them.
  4. The promotion, in collaboration with the competent public administrations, of information, dissemination, training and training actions on Democratic Memory and care for victims, as well as the establishment of lines of collaboration that allow the gathering of information or knowledge of experts in the field.
  5. Collaboration with public administrations and entities that request it in acts of remembrance and tribute to the victims of civil war or dictatorship.
  6. The promotion and coordination of cooperation programs in the field of Democratic Memory with the autonomous communities, local corporations and other organizations.
  7. The proposal to amend the regulations for the acquisition of Spanish nationality by the families of those who lost or had to renounce it as a result of exile.
  8. The management of recruitment files within the competence of the Secretary of State.

  1. Assistance to the head of the Department in supporting the President of the Government.
  2. Implementation of the guidelines and instructions issued by the head of the Department for the organization and coordination of the activities of the Council of Ministers, the Government Delegated Commissions and the General Commission of Secretaries/Secretaries of State and Assistant Secretaries/Subsecretariats.
  3. Support and technical advice to the Department ' s head in the development and approval of the Department ' s action plans.
  4. The direction and coordination of the Ministry ' s common services and, in particular, economic and budgetary planning and management, as well as human, technological and material resources, within the framework defined by the Ministry of Economic Affairs and Digital Transformation for the common services of information and communication systems.
  5. The establishment of personnel and service inspection programmes, as well as the implementation of the necessary actions for the improvement of planning, management and organizational systems and for the rationalization and simplification of procedures and working methods, within the framework defined by the Ministry of Territorial Policy and Public Service. It is also responsible for coordinating the activities related to the Department ' s public policy evaluations in support of the Institute for the Evaluation of Public Policies of the Ministry of Territorial Policy and Public Service, in accordance with the plan of public policy evaluations approved by the Council of Ministers.
  6. The elaboration, where appropriate, and processing of draft provisions of a general nature.
  7. The direction and realization of the organizational projects of ministerial scope.
  8. Communication with the other departments and with the agencies and entities that have a relationship with the Ministry.
  9. The programming, coordination and evaluation of the editorial activity of the General Administration of the State, as well as the execution of the editorial plans of the Department.
  10. Authorizations for the use of the flag, shield or other national symbols, in cases where this is provided for by law.
  11. The promotion and coordination of the institutional relations of the Department, as well as relations with jurisdictional bodies.
  12. Planning and coordination of the activity of the Ministry in the field of cooperation and international relations.
  13. The actions of the Department in relation to effective equality of treatment and opportunities between women and men that affect the personnel of the Department.
  14. Within the scope of the Ministry, the functions that Law 19/2013, of 9 December, on transparency, access to public information and good governance, and its development provisions, attribute to information units, as well as the coordination of open government initiatives.
  15. Coordination and supervision of the policy of protection of personal data within the scope of the competences of the Department and its affiliated public agencies.
  16. The preparation of draft regulations on matters pertaining to the exercise of the right to freedom of religion and worship, and, where appropriate, the reporting of any draft regulations that may affect the exercise of that right.
  17. The promotion, analysis, study, research, technical assistance, monitoring and development of religious and religious freedom, its coordination with the competent bodies of the other departments, collaboration with the institutions and organizations interested in its promotion, as well as the economic-budgetary management of the appropriations allocated for its development.
  18. The ordinary relations with religious entities.
  19. The preparation of proposals for agreements and cooperation agreements with churches, denominations and religious communities and, where appropriate, their follow-up.
  20. The direction and management of the Register of Religious Entities, the organization of the exercise of its function and the proposal for the resolution of administrative appeals against acts arising from the exercise of that registration function.
  21. Relations with national bodies and entities dedicated to the study, promotion and defense of the right to religious freedom and worship, as well as advice to the various public administrations in the implementation of management models adjusted to the constitutional framework that regulates the right to religious freedom in Spain and, in particular, to the constitutional principles of freedom, equality, secularism and cooperation.
  22. Relations with international bodies competent in matters of freedom of religion, belief and religion and, more particularly, in the application and development of international conventions or treaties relating to the aforementioned freedoms.

  • Under the direct supervision of the head of the Department, there will be a special Commissioner for the Reconstruction of the island of La Palma, with the rank of Under-Secretary, who will be responsible for coordinating and promoting the actions adopted by the General Administration of the State for the repair of the damage caused by the volcanic eruptions and for the reconstruction of the island of La Palma.
  • In particular, it will perform the following functions:
  1. To promote the implementation of the measures adopted by the General Administration of the State in this matter.
  2. Carry out the analysis and periodic follow-up of the measures adopted by the General Administration of the State.
  3. To submit periodic reports to the Government on the activities carried out and the results obtained, as well as any proposals deemed necessary for the proper fulfilment of the mandated functions.
  4. To obtain from the various ministerial departments, entities dependent on the General Administration of the State and the Delegation of the Government in the Autonomous Community of the Canary Islands as much information as is necessary for the fulfilment of their functions, and to convene any meetings required for this purpose.
  5. Promote the coordination of the General Administration of the State with the Canary Islands public administrations in this matter.
  6. Support the head of the Ministry of the Presidency, Relations with the Courts and Democratic Memory in the exercise of the functions of the co-presidency of the Joint Commission for Reconstruction, Recovery and Support to the island of La Palma.
  7. To attend, on behalf of the Ministry of the Presidency, Relations with the Courts and Democratic Memory, the sessions and work of the technical group of the Joint Commission for Reconstruction, Recovery and Support to the island of La Palma.
  8. How many other functions are entrusted to him by the person in charge of the Ministry of the Presidency, Relations with the Courts and Democratic Memory.
