A framework agreement is the form of technical rationalization of procurement consisting of pre-establishing a set of conditions or terms that will be common to all contracts based on that framework agreement. This system allows to simplify the management of contracts and facilitate the accession of agencies or entities, as well as Autonomous Communities and Local Entities.
Types of framework agreements
Two types are distinguished:
Those who do not have all the terms or conditions established in the framework agreement: in this case for each based contract, it is obliged to carry out a second tender with the tenderers or tenderers of the framework agreement in which the terms and conditions that were not already predetermined are defined, following the procedure established in article 198.4 of the consolidated text of the Law on Public Sector Contracts.
Those with all the terms or conditions set in the framework agreement itself: in this case it is not necessary to make a second tender. However, some framework agreements promote new tenders when it is envisaged that better market conditions will result from certain specific circumstances, such as large orders, for example.
Contract based on a framework agreement
Any order for products or services made by an organ or body, through a framework agreement, establishes a contract based on that framework agreement between the adjudicator or adjudicator and the person making the request.
Presentation of the information on the Portal
All contracts based on framework agreements can be accessed from the transparency portal. When pressing: “Show all information >”, a list is obtained, sorted by date of award, with all the contracts based and a brief summary of each of them with the following information: framework agreement, adjudicator or, amount and contracting body.
