This page seeks to explain the differences between two legal figures: the orders to own media and the management orders, for the purpose of their publication in the Transparency Portal.
Orders to own media
The Transparency Law obliges the publication of contracts, but not the commissions to their own means (art. 8 of Law 19/2013). Own-media orders are not considered contracts under the Public Sector Contracts Act and, therefore, there is no legal obligation to publish them on the Transparency Portal.
Own-media orders must be published as such on the Public Sector Contracting Platform (PLACSP).
These orders, as there is no legal obligation to be published on the Transparency Portal, are not provided by PLACSP in the daily synchronization that we carry out from the Portal with its systems (this synchronization only turns the information on the contracts).
It must be taken into account that, under the terms of the orders, contracts can be concluded for the execution of the same. These - the contracts - will be subject to the Public Sector Contracts Act and, as such, they must appear in the Transparency Portal (but they will appear as contracts, in the contracts section, coming in the dump that PLACPS supplies us daily automatically)
However, it has been considered advisable to publish access to the Search for orders by own media of the Public Sector Contracting Platform, under the section More transparency.
Agreements and management orders
For these elements of information there is an obligation to publish in the Transparency Portal, according to Law 19/2013 on Transparency Access to Public Information and Good Governance and they are published in the section of “Agreements and Orders”.
To upload this information to the Portal there is an automatic procedure from the RCSPE or REOICO databases.
These data are not uploaded directly to the Portal by the units responsible for them or by the Transparency Information Units, but the units responsible for the order or the agreement will enter them in the corresponding database:
RCESPE, for management orders
REOICO, for the conventions
With both databases there is a daily automatic synchronization to dump this information in the corresponding section of the Portal.
