Ministry of the Interior

1. The promotion of the conditions for the exercise of fundamental rights, in the terms established in the Spanish Constitution and in the laws that develop them, especially in relation to personal freedom and security, the inviolability of the home and communications and the freedom of residence and movement.
2. The exercise of command of the State Security Forces and Bodies, and the coordination and supervision of the services and missions that correspond to them.
3. The powers entrusted to it by the legislation on private security.
4. The direction and coordination of international police cooperation, especially with EUROPOL, INTERPOL, SIRENE, the Schengen Information Systems and the Police and Customs Cooperation Centres.
5. The representation of the Department in the cases in which it is entrusted to it by the Minister.
6. The direction, promotion and coordination of the actions of the Department in the field of organized crime, terrorism, trafficking in human beings, drug trafficking, money-laundering related to such trafficking and related crimes.
7. Planning and coordination of infrastructure and material policies in the field of security.
8. The approval of infrastructure and material plans and programmes in the field of security.
9. The direction and coordination of the Department’s relations with the European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment.
10. The management of the competences of the Department in relation to the protection and guarantee of the exercise of the fundamental rights of assembly and demonstration.
11. Coordination of the exercise of the powers of the Government Delegations and Sub-Delegations in matters of citizen security.
12. The direction and coordination of actions related to drug precursors, explosive precursors and the processing of data from the Passenger Registration System (PNR).
13. The direction of the National Critical Infrastructure Protection System.
14. The direction and coordination of cybersecurity policies within the scope of the Ministry’s competences.
15. Through the General Directorate of International Relations and Foreign Affairs, guarantee autonomy and coordination with regard to operations with transactional effects that may be directed by any of the State Security Forces and Bodies.

1. The senior management of the exercise of the powers assigned to the Directorate-General for Penal Enforcement and Social Reintegration in the field of the management and treatment of penitentiaries, the open environment, alternative measures and prison health, in the terms described in article 6.
2. The function of monitoring, analysis and inspection of the services, agencies and centres of the Penitentiary Administration, especially with regard to personnel, procedures, facilities and endowments, as well as the resolution of reserved information and the processing of disciplinary proceedings initiated against civil and labour personnel assigned to all their units.
3. Coordination in matters within its competence with the peripheral state bodies, with the autonomous communities and with bodies and institutions that can contribute to the better fulfillment of the objectives and purposes of the Prison Administration.
4. To direct the management of human resources and the administration and management of personnel who provide services in centres and units dependent on the General Secretariat.
5. The direction of the economic and financial management of the General Secretariat, as well as the proposals for revision of the Penitentiary Infrastructure Plan and relations with the Society of Penitentiary Infrastructures and Equipment and State Security, S.M.E., S.A.
6. The planning and normative management of penitentiary institutions.
7. To promote compliance with the principles and institutional values and professional ethics of the staff of the Penitentiary Institution or those who provide their services in it; likewise, to promote the policies of equality and the prevention of sexual or gender-based harassment, as well as with respect to workplace harassment.
8. Any other competences attributed to it by the current legislation.

It is the responsibility of the Under-Secretariat:

1. The management and development of the normative policy of the Department, as well as the supervision of the technical-legal foundation of all matters of the Ministry and its dependent agencies that are submitted for the consideration of the General Commission of Secretaries of State and Assistant Secretaries and the Council of Ministers.
2. The coordination, under the superior direction of the head of the Ministry, of the relations of the different governing bodies of the Department with the Autonomous Administrations.
3. The management of the Ministry ' s powers relating to electoral processes and direct consultations with the electorate, the registration of political parties, the management of subsidies and the financing of political parties, as well as the exercise of the right of asylum.
4. The registration of associations at the state level, as well as the declaration of public utility of those that promote the general interest.
5. The management of matters arising from relations with Government Delegations and Sub-Delegations in matters not specifically attributed to other organs of the Department.
6. Coordination and promotion of traffic and road safety policy, and exercise of the Ministry ' s powers over the autonomous agency Central Traffic Headquarters.
7. Management of the Ministry’s competences in relation to civil protection and emergencies.
8. The exercise of the powers assigned to the Ministry in the area of care and support for the victims of terrorism.
9. The coordination, direction and planning of the personnel policy and the remuneration of the staff of the Department.

The Under-Secretariat is responsible, insofar as it is not specifically attributed to other senior or governing bodies of the Department, for the following functions relating to the different areas of common services:

1. To propose the organizational measures of the Ministry; the study of the organizational structure of the Department, and the direction and realization of the organizational projects of ministerial scope.
2. The report and processing of draft laws and draft general provisions in the Department’s own areas, as well as their elaboration, when expressly entrusted to it.
3. The processing and formulation of motions for resolutions and, where appropriate, the resolution of administrative appeals, as well as relations with jurisdictional bodies.
4. The development of the Department ' s editorial programme, and the editing and distribution of publications; the organization and management of libraries and documentation centres, and the management and coordination of the Ministry of the Interior ' s Archives System.
5. The formulation, monitoring, evaluation and revision of the spending programs in which the action plans and projects of the services and agencies of the Department are specified.
6. The fulfillment and development of the instructions issued for the preparation of the budget, as well as the preparation and processing before the Ministry of Finance of the preliminary draft budget of the Department, and the coordination in the preparation of the budgets of its agencies and their consolidation with that of the Ministry.
7. The report and processing of proposals for budgetary modifications of the services and agencies of the Department, as well as the report of the draft provisions and resolutions with impact on public spending.
8. The management of the Department ' s human resources; the annual development of the job offer; the processing of job selection and provision processes; and the planning, development and administration of job templates and relationships and their modifications.
9. The organization and development of training, programming and management of social action, as well as participation in collective bargaining and labor relations.
10. The planning of the remuneration policy, as well as the control and evaluation of the personnel expenditure of the Department.
11. The establishment of inspection programmes for the services of the Ministry, as well as the determination of the necessary actions for the improvement of planning, management and organization systems and for the rationalization and simplification of procedures and working methods. The inspection of the services, of the staff, and the evaluation of their quality and performance, as well as the instruction and proposal for resolution of the disciplinary files and, in general, those foreseen in Royal Decree 799/2005, of 1 July, which regulates the general inspections of services of the ministerial departments, without prejudice to the functions attributed to other organs of the Department.
12. The overall coordination and monitoring of the Department’s quality programs, as well as the processing of authorization or recognition of compatibility files.
13. Supervision of works projects in the cases referred to in article 235 of Law 9/2017, of 8 November, on Public Sector Contracts.
14. The financial management of the Department ' s budget appropriations and treasury expenses; the staffing of the central services, except in the areas of the National Police, the Civil Guard and the General Secretariat of Penitentiary Institutions; the acquisition of the necessary material resources for the operation of the services; the coordination of the various paying agencies of the Department and the channelling of their relations with the General Secretariat of the Treasury and International Finance, the General Intervention of the State Administration and the Court of Auditors, through the central payment unit.
15. Patrimonial management, which includes actions relating to construction and building reform works, relations with the General Directorate of State Heritage, inventory of real estate and the instruction and processing of files on the contracting of real estate rentals, without prejudice to the perfection of contracts by the body competent to conclude them, and the programming, management and control of investments.
16. The internal system, the general registration of the Department and the coordination of registry assistance offices, the management of security services, the surveillance and conservation of buildings, the inventory of movable property and the prevention of occupational risks.
17. The information and attention to the citizen, as well as the functions that Law 19/2013, of December 9, of transparency, access to public information and good governance, and its development provisions attribute to information units within the Department.
18. The development and implementation of strategic and operational plans for information and telecommunication systems; the implementation of e-government; and information technology advice and assistance, as well as ensuring compliance with the accessibility requirements of websites and mobile applications within the Department.
19. The development and implementation of information and telecommunications systems, guaranteeing their interoperability, security and quality, as well as the provision and management of the necessary equipment and computer resources.
20. The management and administration of voice and data communication networks and the management and maintenance of the Internet and Intranet domain and the web portal of the Ministry, in coordination with the people who manage content of the other governing bodies and agencies of the Department.
21. Relations with the ICT Strategy Committee, as well as with other bodies of the Public Administration competent in the matter, and the presidency of the Ministerial Commission of Digital Administration.
22. The coordination and supervision of the data protection policy in compliance with the applicable regulations in this field within the scope of the competences of the Department.
23. Coordination of activities related to public policy evaluations of the Department ' s competence in support of the Institute for Public Policy Evaluation of the Ministry of Territorial Policy and Public Service, in accordance with the plan of public policy evaluations approved by the Council of Ministers.
