Ministry of Territorial Policy and Democratic Memory

The promotion, direction and management of the Government’s policy regarding the organization and territorial activity of the State, the General Administration of the State in the territory, as well as institutional relations with the autonomous communities and local entities.

The coordination, promotion and management of international affairs within the Secretariat of State, without prejudice to the functions of the Ministry of Foreign Affairs, European Union and Cooperation.

The impetus and initiative for the elaboration of the normative projects on the subjects of its competence and those entrusted by the owner of the Department, without prejudice to the corresponding powers of other organs of the Department.

The promotion and coordination of the Conference of Presidents.

The promotion and coordination of cooperation programs in the field of Democratic Memory with the autonomous communities, local corporations and other bodies, in the development of actions aimed at the knowledge and dissemination of Democratic Memory, which include the story of the victims and specifically the memory of women and exile.

Collaboration with the competent ministerial departments and, where appropriate, the proposal of measures to be adopted to promote the actions corresponding to them in application of Law 20/2022, of October 19, on Democratic Memory, as well as the integration and up-to-date maintenance of information relating to such actions.

Relations with the Office of the Public Prosecutor of the Human Rights and Democratic Memory Chamber and with the Ombudsman in matters regulated in Law 20/2022 of 19 October.

The promotion of training, teaching and research in the field of Democratic Memory in all academic fields, in collaboration with universities and other bodies with competence in the field, as well as the establishment of lines of collaboration that allow the gathering of information or knowledge of experts in the field.

Collaboration with the public administrations and entities that request it in the acts of recognition, remembrance and tribute to the victims of the Spanish War or the Dictatorship or in the commemoration of the events representative of the Democratic Memory, such as the impulse of the institutional acts of October 31, of remembrance and tribute to all the victims of the military coup, the War and the Dictatorship, and of May 8, of remembrance and tribute to the men and women who suffered exile as a result of the War and the Dictatorship.

The declaration of Places of Democratic Memory.

The impetus and initiative for the elaboration of the normative projects on the subjects of its competence and those entrusted by the owner of the Department, without prejudice to the corresponding powers of other organs of the Department.

The initiation and resolution of the sanctioning files for infractions classified as very serious by Law 20/2022, of 19 October.

The resolution on the withdrawal of symbols and elements contrary to democratic memory within the scope of the General Administration of the State and its public bodies and entities of public law linked or dependent.

The coordination of the territorial policy of the different ministerial departments that is carried out through the Government Delegations.

Coordination of the activity of the General Administration of the State in the territory and assistance to it, as well as the management of the resources of the Government Delegations, within the competence of the Ministry of Territorial Policy and Democratic Memory.

The promotion of the cooperation and collaboration relations of the General Administration of the State with the autonomous communities and cities of Ceuta and Melilla and with local entities.

The proposal for action on the competitive aspects of relations with territorial administrations.

The legal follow-up and the report on the normative projects, provisions and acts of the State, the autonomous communities and the local entities, on their adaptation to the constitutional order of distribution of competences.

Monitoring of the local regime and cooperation with local authorities, as well as national and European implementation programmes in the local area.

The empowerment of the use of official languages in the General Administration of the State.

The direction, promotion and coordination of the actions related to the participation of the Department in the collegiate bodies of the Government and in those of collaboration and support to the Government.

Assistance to the head of the Ministry in monitoring the effectiveness of the Department.

Legal advice to the person in charge of the Ministry in the performance of the functions assigned to him/her and, in particular, in the exercise of his/her normative power and in the production of administrative acts within the competence of the Ministry, as well as to the other organs of the Ministry.

The preparation of the Ministry’s annual preliminary draft budget, as well as the monitoring of the budget execution and processing of its modifications.

Economic and financial management and planning and monitoring of the administrative contracting of central services.

The planning, direction and administration of the human resources of the Department’s central services and relations with trade union organizations and staff representatives, as well as the management of training plans, social action and occupational risk prevention programs.

The proposal on compatibility, to the body competent to resolve, in relation to the personnel of the Ministry to which the regulations on incompatibilities of personnel in the service of public administrations apply.

Implementation of service inspection plans and programmes and evaluation of the functioning of central service bodies and units.

The exercise of the functions of the Transparency Information Unit of the Ministry, as foreseen in article 21 of Law 19/2013, of 9 December, on transparency, access to public information and good governance, and the support in the coordination of the initiatives of this Department in the field of Open Government; as well as the exercise of the functions of the Complaints and Suggestions Management Unit of the central services of the Department, as foreseen in article 14 of Royal Decree 951/2005, of 29 July, establishing the general framework for the improvement of quality in the General State Administration.

The exercise of the functions of the Equality Unit of the Ministry, as foreseen in article 77 of Organic Law 3/2007, of 22 March, for the effective equality of women and men, and in accordance with Royal Decree 259/2019, of 12 April, which regulates the Equality Units of the General Administration of the State, as well as the exercise of the functions of the Inclusion Unit of People with Disabilities, as foreseen in the fifteenth additional provision of Royal Decree-Law 6/2023, of 19 December, which approves urgent measures for the execution of the Public Service, Resilience,

The management of tangible property, furniture and real estate and its inventory, leases, the execution of works and the maintenance and conservation of the buildings of the central services of the Ministry.

The direction and coordination of the administrative information services and the Registry Assistance Offices, as well as the technical, security, reprography and, in general, internal and general affairs services of the central services of the Ministry.

With regard to the Department ' s central services, the planning, direction and coordination of information system developments; the development, preparation and proposal of technology resource requirements; as well as the provision of information technology services and the direction and coordination of the web portal, electronic headquarters and Intranet.

Elaboration, development and implementation of the digitization plans of the Department, as well as the implementation and monitoring of the digital transformation plans of the General State Administration, with respect to the central services of the Department, in coordination with the General Secretariat of Digital Administration of the Ministry for Digital Transformation and the Public Service.

To promote the implementation of the measures adopted by the General Administration of the State in this matter.

Carry out the analysis and periodic follow-up of the measures adopted by the General Administration of the State.

To submit periodic reports to the Government on the activities carried out and the results obtained, as well as any proposals deemed necessary for the proper fulfilment of the mandated functions.

To gather from the various ministerial departments, entities dependent on the General Administration of the State and the Government Delegation in the Autonomous Community of the Canary Islands as much information as is necessary for the fulfilment of their functions, and to convene any meetings required for that purpose.

Promote the coordination of the General Administration of the State with the Canary Islands public administrations in this matter.

Support the incumbent of the Ministry of Territorial Policy and Democratic Memory in the exercise of the functions of the co-presidency of the Joint Commission for Reconstruction, Recovery and Support to the Island of La Palma.

To attend, on behalf of the Ministry of Territorial Policy and Democratic Memory, the sessions and work of the technical group of the Joint Commission for Reconstruction, Recovery and Support of the Island of La Palma.
