The Ministry of Culture is responsible for proposing and implementing the Government ' s policy on the promotion, protection and dissemination of Spain ' s historical heritage, State museums and the arts, books, reading and literary creation, cinematographic and audiovisual activities and State books and libraries, as well as the promotion and dissemination of culture in Spanish, the promotion of cultural cooperation activities and, in coordination with the Ministry of Foreign Affairs, European Union and Cooperation, international relations in the field of culture.
The promotion of books, comics, reading and Spanish letters.
The promotion, protection and dissemination of state libraries.
The promotion and guarantee of cultural rights.
The defense and promotion of intellectual property.
Cultural cooperation with the autonomous communities.
The promotion, protection and dissemination of the Spanish historical heritage and the state museums.
The promotion, protection and dissemination of state archives.
The coordination of public institutions linked to the ministry, which have attached libraries, museums or collections of cultural goods.
The protection, promotion and dissemination of contemporary artistic creation and the visual arts.
The promotion of cultural facilities.
The conclusion of agreements, in accordance with the provisions of article 62.2.g) of Law 40/2015, of 1 October, with the exception of the signing of the following, which is reserved to the person holding the ministry:
Those that are held with autonomous communities and the cities of Ceuta and Melilla, that are subscribed by the Presidents or Autonomous Councillors and have not delegated this competence.
Those that are held with the municipalities of large population referred to in Law 57/2003, of December 16, on Measures for the Modernization of Local Government, and with the Spanish Federation of Municipalities and Provinces, when the authorities that sign them are their Mayor or their President, depending on the case, and have not delegated this competence.
Those that are held with private natural or juridical persons that have an exceptional character or are considered of special interest to the Ministry.
The ordinary representation of the Ministry.
The external institutional relations and administrative relations of the ministry with other ministerial departments, entities or public administrations within the scope of the competences of the Undersecretariat, without prejudice to the competences attributed to other superior and executive bodies.
Administrative relations with the entities and agencies dependent on the department, without prejudice to the competences attributed to other governing bodies.
The responsibility for providing legal advice to the person in charge of the department in the performance of his/her duties and, in particular, in the exercise of his/her regulatory authority and in the production of administrative acts falling within the department ' s competence, as well as to the other organs of the Ministry.
The impetus, coordination, and monitoring of policy development activities and projects to be approved or proposed to the department.
The direction and impetus of the proceedings relating to the handling of the affairs of the Council of Ministers, Government Delegated Commissions and the General Commission of Secretaries of State and Under-Secretaries.
The senior management of all department staff and the resolution of all matters related to the department, except for cases reserved to the decision of the department owner.
The promotion and coordination of the instructions and orders of service that should be issued for the management of the department’s own matters, as well as the proposal of the organizational measures of the ministry and direct the operation of the common services through the corresponding instructions and orders of service.
Propose the organizational measures of the Ministry; the study of the organizational structure of the department, and the direction and realization of the organizational projects of ministerial scope.
The exercise of the functions of coordination and follow-up of the activity in the field of public policy evaluation at the level of the department and its linked or dependent public agencies, acting as the Coordination Unit of public policy evaluation of the ministry.
The coordination of the institutional advertising campaigns of the department, with the collaboration of the different units and entities proposing.
The coordination and monitoring of the implementation of the investments and reforms of the Recovery, Transformation and Resilience Plan that correspond to the ministry, the realization of reports of follow-up of milestones and objectives and compliance with transversal principles, and reports in relation to the economic-financial management of the application of European funds associated to the Recovery, Transformation and Resilience Plan in the areas of the ministry, and the monitoring of the application of corrective measures by the bodies responsible for the measures, in case of deviations from the fulfillment of milestones and objectives and compliance with transversal principles.
Point of contact with the General Secretariat of European Funds for the monitoring of the measures of the Recovery, Transformation and Resilience Plan that correspond to the ministry.
The management and processing of the credits and expenses assigned to the management center, without prejudice to the competencies of other superior or management bodies of the department and in coordination with them.
The promotion, elaboration, coordination and follow-up of the Strategic Grant Plans of the Ministry.
Specifically, the following functions are assigned to the Office of the Under-Secretary for Culture:
The preparation and processing of the annual preliminary draft budget of the department; the coordination of the preparation of the budgets of the public agencies and their consolidation with those of the department; the analysis and processing of budgetary modifications and the monitoring of the budget.
The economic and financial management of the department.
Assistance to management bodies in the preparation of recruitment files and in the processing of contract award procedures, as well as assistance and support to the department’s recruitment bureau and board.
The coordination and control of the performance of the department’s payers through the Central Cash Unit, as well as the processing of payments that are made through the special payment procedures to be justified and fixed cash advance.
The direction, promotion and general coordination of the common services of the department, security services, maintenance and internal regime of the buildings, as well as the formation of the inventory of movable goods and equipment of the general administrative units.
The planning, management and administration of the human resources of the department and, where appropriate, of its public agencies, the development of job relations and the management of remuneration, relations with trade unions and professional associations of civil servants, as well as collective bargaining as appropriate.
The elaboration of the training plans of the personnel of the department and the direction of its execution and the planning, direction and management of social action and the prevention of occupational risks, without prejudice to the competences attributed to other units.
The general inspection of the organs, units and bodies dependent or attached to the department, the proposals for the improvement of the quality of services, as well as any other function included in Royal Decree 799/2005, of 1 July, which regulates the general inspections of services of ministerial departments, or is attributed to it by the current legal system.
Monitoring of the effectiveness of public bodies, which will be aimed at assessing compliance with the objectives of the specific activity of the entity and the proper use of resources.
The management of the internal information channel, as well as the maintenance of the information contained in the Administrative Information System.
The exercise of the functions of Equality Unit of the ministry, as foreseen in article 77 of Organic Law 3/2007, of 22 March, for the effective equality of women and men and in accordance with Royal Decree 259/2019, of 12 April, which regulates the Equality Units of the General Administration of the State, as well as the exercise of the functions of Inclusion Unit of People with Disabilities, as foreseen in the fifteenth additional provision of Royal Decree-Law 6/2023, of 19 December, which approves urgent measures for the execution of the Public Service and Recovery Plan.
The design of policies for the promotion of cultural industries in coordination with the Secretary of State for Culture, as well as their development, or the coordination of activities when they correspond to specific competences of the rest of the management centers or public agencies of the department. At the international level, these powers will also be exercised in coordination with the Sub-Directorate General for International Relations and the European Union.
The design of policies and the implementation of programmes to promote and promote digital culture in coordination with the State Secretariat for Culture. The promotion of cultural patronage through the development of activities aimed at its dynamization, and participation, together with other bodies of the General Administration of the State competent in the field of patronage, in the development of measures that favor social participation in the financing of the cultural sector.
(ñ) Promotion, coordination and rationalization of the information and communication technology policy of the Ministry and its various agencies, as well as coordination and cooperation with other State administrations and bodies in these matters.
The promotion of the digital administration of the ministry and its agencies in accordance with the Departmental Plan of Action for Digital Transformation and the ICT Strategy of the General Administration of the State and its affiliated public agencies.
The provision of services in the field of information and communication technologies. In particular, the development and administration of the information systems necessary for the operation of the services, technical support to the web portal, electronic headquarters and intranet; the management of communication networks; the promotion of digital transformation and innovation in the department, and the advice and assistance to users in the field of information and communication technologies.
The exercise of the powers attributed as the Registration Authority of the department in relation to the issuance of electronic certificates for its public employees.
