The Ministry of Economy, Trade and Enterprise is the department of the General Administration of the State responsible for the proposal, coordination and execution of the Government's policy in economic matters, through reforms to improve competitiveness and trade, focused on support for the company and the potential growth of the economy. To this end, it relies on the necessary dialogue between the European Union and other International Economic and Financial Bodies. At the same time, he directs the commercial policy of internationalization of companies, as well as the supervision of investments and foreign transactions. Likewise, it is responsible for establishing the provisions and guidelines necessary for its operation, as well as the other competences and powers conferred on it by the legal system.
The Secretariat of State for Economy and Enterprise Support, under the superior direction of the holder of the Ministry of Economy, Trade and Enterprise, exercises the functions set out in article 62 of Law 40/2015, of 1 October, on the Legal Regime of the Public Sector, within the scope of its competences, relating to the treasury of the State, the management of public debt, financial policy and the regulation of financial institutions, capital markets, insurance and reinsurance, capitalization and pension funds, the policy of prevention of money laundering and the representation in the economic institutions and in the corresponding economic forums.
The Secretary of State for Trade, under the superior direction of the holder of the Ministry of Economy, Trade and Enterprise, exercises the functions set out in article 62 of Law 40/2015, of 1 October, within the scope of its competences, relating to the definition, development and execution of the commercial policy of the State, with regard to foreign and domestic trade, including intra-community trade, as well as to the competitive strategy of internationalization policy, foreign investments and foreign transactions, and to the activities of promotion and internationalization of Spanish companies that in these matters correspond to the General Administration of the State.
The ordinary representation of the Ministry.
The institutional relations of the department, without prejudice to the competences attributed to other superior and executive bodies.
Support to the higher organs of the department in the planning of the activity of the Ministry through the corresponding technical advice.
Assistance to the head of the Ministry in monitoring the effectiveness of the department and its public agencies.
The proposal of the organizational measures of the Ministry and the direction and exercise of the competences of the common services, through the corresponding instructions or service orders.
The senior leadership of all the personnel of the department and the resolution of all matters related to it, except for cases reserved to the decision of the person in charge of the Ministry or of the persons in charge of the Secretariats of State.
The responsibility for providing legal advice to the person in charge of the Ministry in the performance of the functions assigned to him/her and, in particular, in the exercise of his/her regulatory authority and in the production of administrative acts within his/her competence, as well as to the other organs of the Ministry.
Coordination of the actions related to the participation of the department in the collegiate bodies of the Government and in those of collaboration and support to the Government.
The planning, management and administration of the human resources of the department, the development of job relations, the management of salaries and relations with trade union organizations and professional associations of civil servants.
The planning and management of staff training plans, without prejudice to the competences of other management bodies of the department in this matter, and the management of social action and occupational risk prevention programs.
The management of the material resources of the department; the adequacy and conservation of the buildings of the central services and the maintenance of their facilities; the general register of the Ministry; the technical, security, reprography services and, in general, the other general and internal services.
Planning, coordination, elaboration and direction of the projects of works.
The study, preparation and proposal of the contracts to be concluded by the Department, without prejudice to the competences attributed to other organs of the Department; as well as the coordination of the collegiate bodies of the Department in the matter of contracting; the coordination and execution of the economic and financial management of the Department; the patrimonial management of the Department related to the affectation, the leasing of real estate and the maintenance of the inventory of movable and immovable property. All this, without prejudice to the functions of the management centers of the Department in these matters in the terms provided in this Royal Decree and its development regulations.
The direction, drive and coordination of e-government in the department.
The promotion of the use of new information and communication technologies by the organs of the Ministry, and coordination of their agencies, as well as in their relations with citizens.
The design, implementation and maintenance of information systems in the Ministry, including the Intranet, the web portal and the electronic headquarters; the provision and management of computer equipment and services and internal communications networks; the implementation of computer security measures and the management of the departmental user service center. All this without prejudice to the competences of other management centres and agencies of the Ministry and coordination with them.
The preparation of the Ministry’s annual budget proposal and the coordination of those corresponding to its affiliated public agencies, as well as the monitoring of the budget execution and the authorization or, where appropriate, processing of its modifications.
The inspection of services of the organs and bodies dependent or attached to the department, with the form and scope provided in section 3.c), the proposals for the improvement of the quality of services, as well as any other function that, within the nature of the competences of the inspections of services, is attributed to them by the legal system in force as provided in Royal Decree 799/2005, of 1 July, which regulates the general inspections of services of the ministerial departments.
Those of the Equality Unit of the department, provided for in article 77 of Organic Law 3/2007, of March 22, for the effective equality of women and men, and in Royal Decree 259/2019, of April 12, which regulates the Equality Units of the General Administration of the State.
The approval of the annual service inspection plan.
The exercise of disciplinary authority for serious or very serious misdemeanours of the staff of the department, except for separation from service.
The protectorate of foundations whose purposes are linked to the attributions of the department, in the terms established by the current regulations.
The application and monitoring of austerity measures and rationalization of public spending through specific instructions on the use of resources of the department and the agencies attached to it.
Approval of service commissions entitled to compensation for departmental staff and commissions entitled to compensation for the exact amount of senior positions attached to the Under-Secretariat.
Those relating to the data protection delegate, provided for in Regulation (EU) 2016/679, of the European Parliament and of the Council, of 27 April 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), and in Organic Law 3/2018, of 5 December, on the Protection of Personal Data and guarantee of digital rights, for the scope of the Ministry, excluding its Public Bodies.
Coordination of public policy evaluations of the department according to the plan of public policy evaluations approved by the Council of Ministers, with the support of the Institute for the Evaluation of Public Policies.
The coordination of accessibility information for all web pages and web pagesappsmobile devices within the department and affiliated bodies, which must be transferred to the Web Accessibility Observatory (OAW) within the framework of its reporting obligations to the European Union (Directive (EU) 2016/2102 of the European Parliament and of the Council of 26 October 2016 on the accessibility of websites and mobile applications of public sector bodies).
The preparation of the Ministry ' s Strategic Grants Plan, which will cover the grants of both its organs and the agencies and other public bodies linked to it, its annual updates, as well as the Annual Progress Reports on the implementation of the Plan and the Final Evaluation Report.
The management of the communication functions of the Ministry of Economy, Trade and Enterprise in coordination with the Cabinet of the person in charge of the Ministry, the carrying out of studies and reports of general interest to the department, the organization, management and maintenance of the libraries, archives of the department and their documentation, as well as the provision of the administrative information service of the department, the functions that Law 19/2013, of 9 December, on transparency, access to public information and good governance, attributes to the information units and the support in the coordination of the initiatives in the field of open government at the level of the Ministry.
Coordination of the institutional and communication publicity of the management centers and dissemination of the general information of the Department, as well as the definition and coordination of the contents of the web portal of the Ministry.
The coordination of the competent national authorities in the field of financial stability within the framework of AMCESFI and the promotion of the adoption of the necessary measures, also in the field of operational risk management.
Monitoring and analysis of the financial sector and the evolution of national and international markets, including the preparation of periodic reports.
The permanent representation of the Kingdom of Spain in the Financial Stability Council and its working groups, and the monitoring, elaboration and coordination of the positions of the department in relation to initiatives at European and international level to promote financial stability and, in particular, those linked to the monetary system.
The collection and exploitation of financial economic databases for the generation of quantitative analysis that supports the design, execution, monitoring and evaluation of financial policies.
National coordination of the preparation and development of the Financial Stability Assessment Program of the International Monetary Fund.
The design, development and maintenance of the IT applications of the General Secretariat, as well as the coordination of the preparation of the preliminary draft budget proposal, the contracting, management and processing of the credits and expenses assigned to the General Secretariat, and the organization and management of the resources assigned to it; all this, without prejudice to the competences of other superior or executive bodies of the Department and in coordination with them.
The monitoring of the management by FROB of its portfolio of shares, shares, securities and other instruments and, in particular, of the activity of the Company for the Management of Assets Coming from Bank Restructuring, SA (SAREB).
The advice, and authorizations where appropriate, in relation to the investments of funds, as soon as it is attributed to it and, in particular, of the Internationalization Risk Reserve Fund, the Fund for the financing of the activities of the General Plan of Radioactive Waste and the advice of the Social Security Reserve Fund through participation as a member of the Investment Advisory Commission and the Management Committee.
Technical support and advice for the implementation of the financial instruments of the Addendum to the Recovery, Transformation and Resilience Plan, in particular, those whose implementation is planned through the Official Credit Institute and the European Investment Bank, without prejudice to the competences assigned to the subject by the European Funds General Subdirectorate.
