Ministry of Territorial Policy

1. The State Secretariat for Territorial Policy is the highest organ of the Department responsible, under the superior direction of the person in charge of the Ministry, for the promotion, direction and management of the Government’s policy regarding the organization and territorial activity of the State, the General Administration of the State in the territory, as well as institutional relations with the autonomous communities and local entities.
   Likewise, under the direction of the head of the Ministry, it is responsible for the coordination, promotion and management of international affairs that occur within the Secretariat of State, without prejudice to the functions that correspond to the Ministry of Foreign Affairs, European Union and Cooperation.
2. Likewise, the State Secretariat for Territorial Policy is responsible for promoting and coordinating the Conference of Presidents, as well as the Presidency of the Council of Official Languages in the General Administration of the State.

The General Secretariat for Territorial Coordination is the governing body responsible, under the authority of the holder of the State Secretariat for Territorial Policy and Public Service, for promoting and coordinating the competences attributed to the department relating to territorial policy, both autonomous and local, and in particular the functions listed below:

1. The coordination of the territorial policy of the different ministerial departments that is carried out through the Government Delegations.
2. Coordination of the activity of the General Administration of the State in the territory and assistance to it, as well as the management of the resources of the Government Delegations, within the competence of the Ministry of Territorial Policy.
3. The promotion of the cooperation and collaboration relations of the General Administration of the State with the autonomous communities and cities of Ceuta and Melilla and with the local authorities.
4. The proposal for action on the competitive aspects of relations with territorial administrations.
5. The legal follow-up and the report on the normative projects, provisions and acts of the State, the autonomous communities and the local entities, on their adaptation to the constitutional order of distribution of competences.
6. The local regime and cooperation with local authorities, as well as national and European implementation programmes in the local area.
7. The empowerment of the use of official languages in the General Administration of the State.

In addition, the General Secretariat for Territorial Coordination, under the authority of the holder of the State Secretariat for Territorial Policy, has the following functions at European and international level of the competences attributed to the department:

1. The preparation of the affairs and implementation of the agreements of the Conference on Matters Related to the European Union and the performance of the functions of the secretariat of the Conference and its supporting bodies.
2. The preparation and monitoring of the participation of the State Secretariat for Territorial Policy in European and international forums and working groups with functions related to territorial, regional and local policy, as well as the articulation of participation in international bodies and entities.
3. The functions related to the cross-border cooperation of the autonomous communities and local entities and the authorization to them for participation in European Groupings of Territorial Cooperation, as well as the preparation of the reports prior to the authorization that corresponds to the Council of Ministers in relation to these groupings, and the preparation of the report of article 11.4 of Law 2/2014, of March 25, of the Action and the Foreign Service of the State, without prejudice to the competences of other ministerial departments.
4. Initiation and instruction of procedures for the determination and impact of liabilities for non-compliance with European Union law or international treaties or conventions to which Spain is a party. However, cases of non-compliance arising from the management of funds from the European Union are excepted, in accordance with article 7.2 of Royal Decree 515/2013, of 5 July, which regulates the criteria and procedure for determining and reversing liabilities for non-compliance with European Union law. It is also responsible for preparing the annual report to the Council of Ministers provided for in the third additional provision of the aforementioned Royal Decree 515/2013, of 5 July.

1. The direction, promotion and coordination of the actions related to the participation of the Department in the collegiate bodies of the Government and in those of collaboration and support to the Government.
2. Assistance to the head of the Ministry in monitoring the effectiveness of the Department.
3. The responsibility for providing legal advice to the person in charge of the Ministry in the performance of his/her duties and, in particular, in the exercise of his/her regulatory authority and in the production of administrative acts falling within the competence of the Ministry, as well as to the other bodies of the Ministry.
4. The preparation of the Ministry’s annual preliminary draft budget, as well as the monitoring of the budget execution and processing of its modifications.
5. Economic and financial management as well as planning and monitoring of administrative contracting.
6. The planning, direction and administration of the human resources of the Department’s central services and relations with trade union organizations and staff representatives, as well as the management of training plans, social action and occupational risk prevention programs.
7. The processing of compatibility files relating to the staff of the Ministry, to which the regulations on incompatibilities of staff in the service of public administrations apply. Likewise, the processing of disciplinary files of the Department’s staff.
8. Implementation of service inspection plans and programmes and evaluation of the functioning of central service bodies and units.
9. The exercise of the functions of the Transparency Information Unit of the Ministry, as foreseen in article 21 of Law 19/2013, of 9 December, on transparency, access to public information and good governance, and the support in the coordination of the initiatives of this Department in the field of Open Government; as well as the exercise of the functions of the Complaints and Suggestions Management Unit of the central services of the Department, as foreseen in article 14 of Royal Decree 951/2005, of 29 July, establishing the general framework for the improvement of quality in the General State Administration.
10. The exercise of the functions of the Equality Unit of the Ministry, as foreseen in article 77 of Organic Law 3/2007, of March 22, for the effective equality of women and men and in accordance with Royal Decree 259/2019, of April 12, which regulates the Equality Units of the General Administration of the State.
11. The management of tangible property, furniture and real estate and its inventory, leases, the execution of works and the maintenance and conservation of the buildings of the central services of the Ministry.
12. The direction and coordination of administrative information services and Registry Assistance Offices, as well as technical, security, reprography and, in general, internal and general affairs services of the Ministry ' s Central Services.
13. With regard to the Department ' s central services, the planning, direction and coordination of information system developments; the development, preparation and proposal of technology resource requirements; as well as the provision of information technology services and the direction and coordination of the web portal, electronic headquarters and Intranet.
14. Elaboration, development and execution of the digitization plans of the department, as well as the implementation and monitoring of the digital transformation plans of the General Administration of the State, with respect to the central services of the Department, in coordination with the General Secretariat of Digital Administration of the Ministry of Economic Affairs and Digital Transformation.
