The procedure for exercising the right of access begins with the submission of the corresponding request (art. 17 LTAIBG). This request can be made telematically in the Electronic Headquarters of the Transparency Portal. The application responsible for managing the request internally is “GESAT”.
2. Novelty
Taking advantage of the days of reduced use of the portal for the summer holidays, the Electronic Headquarters of the Transparency Portal has been completely renovated (https://sede.transparencia.gob.es) as the application that serves to manage the Right of Access requests that are received (approximately 33 per day).
We have technologically modernized both applications (both electronic headquarters and GESAT) to ensure full compliance with the legal framework in force, in particular with the Law 39/2015, of 1 Octoberthe Common Administrative Procedure of Public Administrations and the RD 203/2021, of 30 March, approving the Regulation on the operation and functioning of the public sector by electronic means. It has also been used to modernize its technological base so that they can communicate with the most modern platforms, stopping doing so with the old ones.
All of the above, through the integration of both applications with the horizontal tool Acceda (platform for Citizens’ Access to Administration Files) of the General Secretariat of Digital Administration, thereby promoting reuse, standardization and cost savings.
As a result of the above, citizens obtain the following improvements:
To be able to see the notifications both in the electronic headquarters and in the Single Enabled Electronic Address (DEHú): the single point of notifications for all Public Administrations.
Be able to provide documents in the middle of the procedure from the electronic headquarters itself, without having to do it separately through registration.
Be able to make requests for access through a representative. When a user accesses and indicates that he/she acts on behalf of another, the new headquarters connects in real time to the Electronic Registry of Seizures (REA) to check if there is any power of representation in it, allowing him/her access in the affirmative and thus giving him/her capacity to act on the files of his/her representative.
3. The challenge
This means that, in less than 48 hours, all existing access rights files (more than 55,000) have been migrated from the old system to the new one, as well as the new servers in which both the new management program and the new headquarters reside have been launched and made available on the Internet. The performance began on the morning of August 23 and ended the following day, August 24.
This work has been carried out without affecting the availability of the Transparency Portal of the General Administration of the State (https://transparencia.gob.es), which has been in operation and operational throughout the process, allowing citizens to consult all the information related to Active Advertising and Open Government of the General Administration of the State.
