On January 25, 2022, the consultation process on the reform of the Law on Transparency, Access to Public Information and Good Governance began.
The consultation process has been configured in three large blocks:
1. Prior public consultation
2. Targeted consultations
3. Presentation of the main conclusions of the sub-working group
With regard to the first of these, on the same day, January 25, 2023, the prior public consultation document established by article 133 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations, in relation to article 26.2 of Law 50/1997, of November 27, of the Government, was published on the website of the Ministry of Finance and Public Function, in order to improve the participation of citizens in the procedure of elaboration of the rules, with a deadline for making contributions until February 25, 2023. The system of collection of contributions has been carried out by answering a questionnaire with questions on various aspects of the reform, contemplating the possibility of being able to present attached documents that more broadly collect the contributions of citizens. In relation to the second block, there have been consultations focused on three groups: people over 65 years of age in a situation of vulnerability, older people, under 65 years of age, in a situation of social exclusion and adolescents. The first two activities held on 13 and 20 February 2023 have been carried out in collaboration with the Third Sector Platform and the third that took place on 27 February, 2 and 3 March 2023, have been carried out in collaboration with the Government of the Foral Community of Navarre. Finally, and in relation to the presentation of the main conclusions of the sub-working group on the reform of the Law, these have been made known to the following actors:
Open Government Sectoral Commission and Open Government Forum, in a meeting held on 24 March 2023
In addition, on March 21, 2023, the second edition of the seminar “The Role of the Constitutional Bodies in the Open State and the Law on Transparency” was held at the Center for Political and Constitutional Studies to publicize the main conclusions of the working subgroup, which was attended by the members of the subgroup and representatives of the constitutional bodies and of constitutional relevance. The study and evaluation of the contributions collected from the entire consultation process will serve as a basis for the elaboration of the Regulatory Impact Analysis Report.
